Zerocig dba Aristo Electronic Cigars was cited for manufacturing and selling e-liquid tobacco products without required premarket authorization orders, in violation of the Family Smoking Prevention and Tobacco Control Act and the Federal Food, Drug, and Cosmetic Act. The company's websites offered ENDS (electronic nicotine delivery systems) products for sale in the United States without obtaining the necessary marketing authorization that the FDA requires for "new tobacco products" not commercially marketed before February 15, 2007. The FDA determined the e-liquids met the definition of tobacco products subject to FDA jurisdiction under section 901(b) of the FD&C Act and therefore were required to comply with applicable tobacco product regulations.
