The company's e-liquid products, which fall under FDA's jurisdiction as electronic nicotine delivery systems deemed tobacco products effective August 8, 2016, were being manufactured and offered for sale without the required premarket approval. The FDA determined the products were adulterated and misbranded due to lack of compliance with applicable tobacco product regulations.
