Dr. Thomas Polucki Upper Cervical Chiropractic, Inc. was cited for selling unapproved new drugs (Nitric Oxide Support and Melatonin products) through its website that were intended to mitigate, prevent, treat, diagnose, or cure COVID-19, violating section 505(a) of the Federal Food, Drug, and Cosmetic Act. The products were also found to be misbranded drugs under section 502 of the FD&C Act, with their introduction into interstate commerce prohibited under sections 301(a) and (d).
