East Coast Liquids d/b/a Planet Vapor was cited for manufacturing and distributing e-liquid tobacco products without required premarket authorization under the Family Smoking Prevention and Tobacco Control Act. The company failed to comply with FDA regulations governing newly deemed tobacco products, specifically electronic nicotine delivery systems (e-liquids), which have been subject to FDA jurisdiction since August 8, 2016. The products were found to be adulterated and/or misbranded under the Federal Food, Drug, and Cosmetic Act due to the absence of required premarket authorization for these new tobacco products.
